Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Forensics.us LLC platform, website, and all related services (collectively, the "Service") operated by Forensics.us LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, subscribing to any plan, or accessing any portion of the Service, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to these Terms in their entirety. These Terms constitute a legally binding agreement between you and the Company.

2. Description of Service

Forensics.us LLC provides a market intelligence platform that delivers pre-market analysis, trade signal generation, institutional supply and demand zone identification, and related analytical tools for informational and educational purposes. The Service includes the NORTHSTAR pipeline, FireFly scanner, Insider Recon, Global Markets monitoring, Personal Watchlist (collectively, "Platform Tools").

THE SERVICE IS PROVIDED FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. NOTHING ON THIS PLATFORM CONSTITUTES FINANCIAL, INVESTMENT, TAX, OR LEGAL ADVICE. ALL TRADING AND INVESTMENT DECISIONS ARE MADE SOLELY AT YOUR OWN RISK.

3. Intellectual Property — Proprietary Systems & Protection

All content, technology, methodologies, algorithms, source code, scoring models, signal generation logic, trade card formats, confidence scoring systems, watchlist logic, and analytical frameworks available through the Service — including but not limited to the NORTHSTAR pipeline, SMILE intelligence engine (Stock Market Inference Logic Engine), FireFly scanning methodology, INTERROGATOR Forensic Analysis Workstation, GENIUS custom studies, to include HBuy% scoring model, apex convergence calculations, institutional zone detection algorithms, (collectively, "Proprietary Systems") — are the exclusive intellectual property of Forensics.us LLC and are protected under United States and international copyright, trade secret, trademark and intellectual property laws.

You are expressly prohibited from:

  • Copying, reproducing, distributing, publishing, or transmitting any Proprietary Systems or Platform Tools in whole or in part, in any form or by any means
  • Reverse engineering, decompiling, disassembling, or attempting to derive the source code, underlying logic, algorithms, or methodology of any Platform Tool or Proprietary System
  • Creating derivative works based on any Proprietary System, scoring model, or analytical methodology
  • Uploading, posting, or distributing any Platform Tool, study, or scanner to any public or private repository, forum, marketplace, or sharing platform including but not limited to GitHub, Discord, Telegram, Reddit, or any trading community platform
  • Using any Platform Tool or Proprietary System to build, train, or improve a competing product or service
  • Scraping, harvesting, or systematically extracting data, signals, or outputs from the Service by automated means
  • Removing, altering, or obscuring any proprietary notices, watermarks, or attribution within Platform Tools

Any unauthorized use, reproduction, or distribution of Proprietary Systems constitutes a material breach of these Terms and may result in immediate account termination, civil liability for damages, and criminal prosecution under applicable intellectual property laws. Forensics.us LLC reserves the right to pursue all available legal and equitable remedies for any such violation, including injunctive relief, actual damages, statutory damages, and attorney's fees.

The trade names, trademarks, service marks, and logos of Forensics.us are the exclusive property of the Company. No license or right to use any mark is granted without prior written permission from the Company.

4. License Grant & Permitted Use

Subject to your compliance with these Terms and payment of applicable subscription fees, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service and Platform Tools solely for your own personal, non-commercial trading and investment analysis purposes. This license does not include any right to resell, redistribute, publicly display, or commercially exploit any portion of the Service.

5. Subscription Plans & Payment

Access to certain features of the Service requires a paid subscription. Subscription fees are charged in advance on a monthly or annual basis as selected at the time of purchase. All fees are in US dollars. By providing payment information, you authorize the Company to charge the applicable fees to your payment method.

Forensics.us LLC reserves the right to modify subscription pricing at any time with at least 30 days' notice to existing subscribers. Continued use of the Service following a price change constitutes acceptance of the new pricing.

All fees charged by the Company in connection with any subscription or service are exclusive of any taxes, levies, or duties imposed by any taxing authority, and you shall be solely responsible for the payment of all such taxes, levies, or duties arising from your use of the Service. Forensics.us LLC is not responsible for determining whether any taxes apply to your transaction, and it is your sole responsibility to comply with all applicable tax laws and regulations.

6. No Financial Advice — Investment Risk Disclosure

FORENSICS.US LLC IS NOT A REGISTERED INVESTMENT ADVISOR, BROKER-DEALER, OR FINANCIAL PLANNER. ALL CONTENT, SIGNALS, TRADE CARDS, ANALYSIS, AND INFORMATION PROVIDED THROUGH THE SERVICE IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE INVESTMENT ADVICE OR A RECOMMENDATION TO BUY, SELL, OR HOLD ANY SECURITY.

Forensics.us LLC relies upon the "publisher's exclusion" from the definition of "investment adviser" as provided under Section 202(a)(11)(D) of the Investment Advisers Act of 1940 and corresponding state securities laws. As such, the Company does not offer or provide personalized investment advice. To the extent any content, signals, trade cards, or other informational output published through the Service may be deemed to be "investment advice," such information is impersonal and not tailored to the investment needs of any specific person.

Past performance of any signal, trade card, or analytical output does not guarantee future results. All trading involves substantial risk of loss. The purchase and sale of securities should only be conducted by persons who understand and accept the risks involved therewith, and who have independently determined their suitability and acceptance of those risks and the financial and tax consequences thereof. Only persons who are able to bear the risk of substantial or complete loss of funds should engage in the purchase and sale of securities.

You remain solely responsible for all decisions regarding your purchase and sale of securities, the suitability, profitability, or appropriateness for you of any security, investment, financial product, or investment strategy. No data, content, or information provided through the Service is intended to constitute, nor shall it be construed as, advice or any recommendation to buy, sell, or hold any security, nor any offer or solicitation of an offer to buy or sell any security, nor an attempt to influence the purchase or sale of any security. Forensics.us LLC does not track the trading results of its subscribers. As a provider of informational and educational market intelligence services, the Company does not have access to the personal trading accounts or brokerage statements of its subscribers. Available research data suggests that the majority of active traders are not consistently profitable.

In a research paper published in 2014, professors from the University of California studied 3.7 billion trades from the Taiwan Stock Exchange between 1992–2006 and found that only 9.81% of day trading volume was generated by predictably profitable traders, and that predictably profitable traders constitute less than 3% of all day traders on an average day. A 2005 study published in the Journal of Applied Finance found that out of 1,146 brokerage accounts day trading U.S. markets, only 50% were profitable. A 2003 study published in the Financial Analysts Journal found that out of 334 brokerage accounts day trading U.S. markets, only 35% were profitable and only 14% generated profits in excess of $10,000. These studies indicate that consistently making money trading securities is not easy. Day trading is a high-risk activity and can result in the loss of your entire investment. Any trade or investment is at your own risk.

PENNY STOCK DISCLAIMER: The Service may, from time to time, include analysis, signals, or informational content related to securities commonly referred to as "penny stocks" — generally securities trading at low prices with smaller market capitalizations. Trading such securities carries unique and significant risks compared to trading securities with larger market capitalizations, including but not limited to:

  • Lack of public information: Reliable, publicly available information about certain low-price securities may not be available or as accessible as information about larger-cap securities. As a result, it is less likely that quoted prices will reflect full and accurate information about the issuer.
  • No minimum listing standards: Companies trading on OTC markets may be subject to reduced or no minimum listing standards regarding net assets, shareholders, or financial disclosures.
  • Liquidity risk: Demand may not be constant for low-price securities, which means they may be significantly more difficult to buy or sell at quoted prices, and this could materially impact the price you receive.

Forensics.us LLC's platform applies price and volume filters designed to reduce, but not eliminate, exposure to the risks described above. Forensics.us LLC makes no representation that its filtering methodology will prevent losses in any security. You bear sole responsibility for evaluating the risks of any security identified through the Service.

6c. Market Non-Manipulation Statement

Forensics.us LLC does not engage in, and its business and activities shall not constitute or be construed as, any activity with the purpose of creating a false or misleading appearance of active trading in any security, effecting transactions involving no change in beneficial ownership, entering coordinated buy and sell orders at substantially the same time and price, or engaging in any series of transactions for the purpose of raising or depressing the price of any security to induce purchases or sales by others. Forensics.us LLC does not engage in, and its activities shall not constitute, any activity to peg, fix, or stabilize the price of any security in contravention of any applicable law, rule, or regulation.

You understand, acknowledge, and agree that the Company and its personnel engage in independent trading of securities in their personal capacities, but do not willfully participate in any manipulative activity described above. Accordingly, you hereby waive and release any and all claims, losses, damages, liabilities, and any other costs and expenses, arising from or related to your purchase or sale of a security at a price that may have been affected by any activity of the Company or its personnel in their individual trading capacities.

6d. Personnel Trading Disclosure

Forensics.us LLC's personnel, including its founders, operators, employees, and affiliates, are active investors and traders of securities. Such parties may, but are not required to, purchase or sell any security identified in or generated by the Service. Such parties will make trading decisions in their sole discretion, at any time, and without notice, and are not required to disclose or notify subscribers with respect to any such decisions or activities. Personnel of the Company may hold positions in securities discussed through the Service, and such positions may be inconsistent with signals or analysis generated by the Platform Tools. Forensics.us LLC's personnel adhere to their own individual trading plans, and their experiences are not typical and will not be duplicated by subscribers.

6e. United States Only

The Service is solely directed to and intended for individuals residing in the United States. The securities laws, regulations, and investor protections described in these Terms are based on United States law. Those who choose to access and use the Service from outside the United States do so entirely at their own risk and are solely responsible for compliance with all laws, rules, and regulations applicable in their jurisdiction. Forensics.us LLC reserves the right to limit the availability of the Service to any person, geographic area, or jurisdiction at any time and in its sole discretion.

7. Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation, including without limitation any law, rule, or regulation related to securities or investments, or any rules promulgated by the U.S. Securities and Exchange Commission
  • Attempt to gain unauthorized access to any portion of the Service or its underlying systems
  • Interfere with or disrupt the integrity or performance of the Service, including denial-of-service attacks or overloading platform infrastructure
  • Use the Service to engage in market manipulation or any fraudulent trading activity
  • Share your account credentials with any third party or make your account or any portion thereof available to the general public
  • Create multiple accounts to circumvent subscription restrictions or access controls
  • Use automated tools, bots, spiders, or scrapers to access or extract data, signals, or outputs from the Service
  • Promote, offer for sale, or resell any signal, trade card, or analytical output from the Service to any third party
  • Post or make any defamatory, disparaging, or false statements, claims, or allegations related to the Service or the Company
  • Issue chargeback disputes against the Company without first contacting support and allowing a reasonable opportunity to resolve the issue
  • Use the Service in connection with any multi-level marketing, pyramid scheme, or similar activity
  • Upload, transmit, or introduce any virus, malicious code, or other harmful material to the Service
  • Decompile, reverse engineer, or attempt to derive the source code, algorithms, or methodology of any Platform Tool or Proprietary System
8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FORENSICS.US LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORENSICS.US LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR TRADING LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FORENSICS.US LLC'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO FORENSICS.US LLC IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Testimonials & Endorsements

In accordance with 16 CFR Part 255 and Federal Trade Commission Guidelines concerning the use of endorsements and testimonials in marketing and advertising, please be aware of the following:

Endorsements, testimonials, or descriptions of past performance from subscribers or users of the Service are based upon their individual experiences and results. These results and performances are not typical, and you should not expect to achieve the same or similar results. The endorsements, testimonials, or descriptions of past performance reflect real individual experiences and are not representative of the results of all subscribers.

No endorsements, testimonials, or descriptions from subscribers or users appearing on or in connection with the Service involved payment or compensation therefor, unless explicitly disclosed. Any individual featured in a testimonial or endorsement is an individual subscriber sharing their personal experience, not a representative of typical outcomes.

Forensics.us LLC may express or utilize testimonials or descriptions of past performance, but such items are not indicative of future results or performance, and do not constitute any representation, warranty, or guaranty that any result will be obtained by you. Your results may differ materially from those expressed or utilized by the Company or its subscribers.

12. Termination

Forensics.us LLC reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination — including but not limited to intellectual property provisions, disclaimer of warranties, and limitation of liability — shall survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively through binding arbitration in New Mexico under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Modifications to Terms

Forensics.us LLC reserves the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on the Service at least 14 days prior to taking effect. Your continued use of the Service after the effective date of any modification constitutes your acceptance of the updated Terms.

This Privacy Policy describes how Forensics.us LLC ("Company," "we," "us," or "our") collects, uses, and protects information about you when you use the forensics.us platform and related services. By using the Service, you consent to the practices described in this policy.

1. Information We Collect

We collect the following types of information:

  • Account Information: name, email address, password (hashed), and subscription tier when you register
  • Payment Information: billing details processed securely by Stripe; we do not store full credit card numbers
  • Usage Data: features accessed, signals viewed, tickers searched, session duration, and platform interactions
  • Watchlist Data: tickers you add to your Personal Watchlist
  • Technical Data: IP address, browser type, device type, operating system, and referring URLs
  • Communications: emails or messages you send to us
2. How We Use Your Information

We use collected information to:

  • Provide, maintain, and improve the Service
  • Process payments and manage your subscription
  • Send service-related communications including account confirmations, receipts, and security alerts
  • Send the Daily Brief and market intelligence emails you have opted into
  • Enforce our Terms of Service and protect the security of the platform
  • Analyze usage patterns to improve platform performance and feature development
  • Comply with legal obligations
3. Information Sharing

We do not sell, rent, or trade your personal information to third parties. We share information only in the following limited circumstances:

  • Service Providers: Stripe (payment processing), Supabase (database infrastructure), Resend (email delivery) — each under confidentiality obligations
  • Legal Requirements: when required by law, court order, or governmental authority
  • Business Transfer: in connection with a merger, acquisition, or sale of company assets, with notice to affected users
  • Protection of Rights: when necessary to protect the rights, property, or safety of the Company or its users
4. Data Security

We implement industry-standard security measures including HTTPS/TLS encryption for all data in transit, encrypted storage for sensitive data, hashed passwords, and access controls limiting data access to authorized personnel. While we take reasonable precautions, no method of transmission or storage is 100% secure. You are responsible for maintaining the confidentiality of your account credentials.

5. Data Retention

We retain your account data for as long as your account is active or as needed to provide the Service. If you cancel your subscription or close your account, we will retain your data for up to 90 days before deletion, except where retention is required by law or for legitimate business purposes such as fraud prevention.

6. Local Storage & Tracking

The Service uses browser local storage to maintain your authenticated session token and platform preferences (such as cached signal data and user tier). We do not use HTTP cookies, third-party advertising cookies, or behavioral tracking technologies. Clearing your browser's local storage will end your active session. We do not use analytics tracking pixels, ad networks, or behavioral profiling tools of any kind.

7. Your Rights

You have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate information
  • Request deletion of your account and associated data
  • Opt out of marketing email communications at any time via unsubscribe link
  • Data portability — request a copy of your data in a machine-readable format
8. Children's Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us with personal information, contact us immediately and we will delete it.

9. Changes to This Policy

We may update this Privacy Policy periodically. Material changes will be communicated via email or notice on the platform. Continued use of the Service following notice of changes constitutes acceptance of the updated policy.

Refund Policy

This Refund Policy governs all subscription purchases made through the forensics.us platform operated by Forensics.us LLC. By subscribing to any paid plan, you acknowledge and agree to this policy.

1. Monthly Subscriptions

Monthly subscriptions may be cancelled at any time through your account settings or by contacting support. Upon cancellation, your subscription will remain active through the end of the current billing period. No partial refunds are issued for unused portions of a monthly subscription period. Your access will continue until the billing period ends, after which it will not renew.

2. Annual Subscriptions

Annual subscriptions include a 30-day money-back guarantee from the date of initial purchase. If you are not satisfied with the Service for any reason, you may request a full refund within 30 days of your purchase date by contacting us at the email below.

After the 30-day window, annual subscriptions are non-refundable. Upon cancellation of an annual subscription after 30 days, your access will continue through the end of the annual billing period. No partial or pro-rated refunds will be issued for the remaining unused portion of an annual subscription term.

3. How to Request a Refund

To request a refund within the eligible window, email us at contact [at] forensics.us with your account email address, purchase date, and reason for the refund request. Eligible refunds will be processed within 5–10 business days to your original payment method.

4. Exceptions

Refunds will not be issued in the following circumstances:

  • Requests made after the applicable refund window has expired
  • Accounts terminated for violation of the Terms of Service
  • Claims of technical issues that were not reported to support prior to the refund request
  • Dissatisfaction with trading outcomes or signal performance — the Service is informational only and past performance does not guarantee future results
  • Duplicate accounts or accounts created to circumvent subscription restrictions
5. Chargebacks

We encourage you to contact us directly before initiating a chargeback with your financial institution. Unresolved chargebacks may result in immediate account suspension. We reserve the right to dispute chargebacks we believe to be filed in error or in bad faith, and to provide transaction records and these Terms as evidence in any dispute resolution process.

6. Free Plan

The RECON (free) tier does not involve any payment and is therefore not subject to this refund policy. Free tier access may be modified or discontinued at any time.

7. Modifications

Forensics.us LLC reserves the right to modify this Refund Policy at any time. Changes will apply to subscriptions purchased after the effective date of the modification. Existing subscribers will be notified of material changes at least 14 days in advance.
